Abstract Na temelju članka 89. Ustava Republike Hrvatske Predsjednik Republike Odlukom proglašava zakone koji su izglasani u Hrvatskom saboru. U svrhu provedbe zaštite na radu i zaštite od požara izglasani su zakoni, Zakon o zaštiti na rad čija je svrha sustavno unapređivanje sigurnosti i zaštite zdravlja radnika i osoba na radu, sprječavanje ozljeda na radu, profesionalnih bolesti i drugih bolesti u vezi s radom te Zakon o zaštiti od požara koji uređuje sustav zaštite od požara s ciljem zaštite života, zdravlja i sigurnosti ljudi i životinja te sigurnosti materijalnih dobara, okoliša i prirode od požara, uz društveno i gospodarski prihvatljiv požarni rizik. Zaštita od požara od posebnog je interesa za Republiku Hrvatsku. Zakonom o zaštiti na radu se u pravni poredak Republike Hrvatske prenose Direktive Europske unije koje se odnose na poboljšanja sigurnosti i zdravlja na radu. Zakon o zaštiti na radu propisuje odgovornost poslodavca za organiziranje i provođenje zaštite na radu u svim dijelovima organizacije rada i u svim radnim postupcima te pravilnikom ili drugim aktima utvrdit organizaciju provedbe zaštite na radu. U tu svrhu Poslodavac je obvezan utvrditi i obavljati poslove zaštite na radu u skladu s procjenom rizika, stanjem zaštite na radu i brojem radnika. Ovisno o rizicima, djelatnosti i broju radnika, posebnim pravilnikom propisuju se vrste, stupnjeve stručne spreme i broj stručnjaka zaštite na radu s kojima Poslodavac je obvezan ugovorom o radu ugovoriti s jednim ili više stručnjaka zaštite na radu. U svrhu provođenja mjera i organizacije zaštite od požara za građevine, građevinski dijelovi i drugih nekretnina ti prostori razvrstavaju se rješenjem ministra u jednu od četiri propisane kategorije ugroženosti od požara. Ovisno o razvrstanoj kategoriju ugroženosti od požara vlasnici, odnosno korisnici istih građevina dužni su organizirati službu zaštite od požara i zaposliti djelatnika u službi ili zaposliti djelatnika zaduženog za obavljanje poslova zaštite od požara i unapređenje stanja zaštite od požara. U provođenju zaštite na radu i zaštite od požara poslodavac mora upoznati radnike o svim rizicima te provesti odgovarajuća osposobljavanja.
Abstract (english) Pursuant to Article 89 of the Constitution of the Republic of Croatia, the President of the Republic promulgates by a decision the laws passed in the Croatian Parliament. In order to implement occupational safety and fire protection, laws were passed, the Occupational Safety and Health Act whose purpose is to systematically improve the safety and health of workers and persons at work, prevention of injuries at work, occupational diseases and other work-related diseases on fire protection, which regulates the fire protection system with the aim of protecting the life, health and safety of humans and animals and the safety of material goods, the environment and nature from fire, with socially and economically acceptable fire risk. Fire protection is of special interest to the Republic of Croatia. The Occupational Safety and Health Act transpose into the legal order of the Republic of Croatia the Directives of the European Union relating to the improvement of safety and health at work. The Occupational Safety and Health Act prescribes the responsibility of the employer for the organization and implementation of occupational safety in all parts of the organization of work and in all work procedures, and to determine the organization of the implementation of occupational safety in regulations or other acts. For this purpose, the Employer is obliged to determine and perform occupational safety activities in accordance with the risk assessment, the state of occupational safety and the number of employees. Depending on the risks, activities and number of employees, a special ordinance prescribes the types, levels of education and the number of occupational safety experts with whom the Employer is obliged to contract with one or more occupational safety experts. For the purpose of implementing measures and organization of fire protection for buildings, construction parts and other real estate, these areas are classified by the decision of the Minister into one of the four prescribed categories of fire risk. Depending on the classified category of fire risk, the owners or users of the same buildings are obliged to organize a fire protection service and hire an employee in the service or hire an employee in charge of performing fire protection activities and improving the state of fire protection. In the implementation of occupational safety and fire protection, the employer must inform workers about all risks and conduct appropriate training.
