| Abstract | Gospodarski subjekti dužni su postupati po Zakonu o zaštiti od požara („Narodne novine“, broj 92/2010), Pravilniku o razvrstavanju građevina, građevinskih dijelova i prostora u kategorije ugroženosti od požara („Narodne novine“, broj 62/1994) i rješenju o razvrstavanju u kategoriju ugroženosti od požara te ovisno o kategoriji u koju su razvrstani poduzimati zakonom i pravilnikom propisane mjere, izraditi opće akte, organizirati vatrogasnu službu s određenim brojem vatrogasaca i službu zaštite od požara, te istu financirati iz vlastitih sredstava. Prema Zakonu o vatrogastvu („Narodne novine“, broj 125/19) vatrogasne postrojbe u gospodarstvu mogu biti profesionalne i dobrovoljne. Gospodarski subjekt obavezan je ustrojiti vatrogasnu službu ako je prema rješenju razvrstan u I. ili II. kategoriju ugroženosti od požara, te se tada temeljem procjene ugroženosti i plana zaštite od požara ustrojava profesionalna vatrogasna postrojba. Broj obaveznih profesionalnih vatrogasaca smanjuje se ukoliko se povećava broj dobrovoljnih vatrogasaca, a dobrovoljan vatrogasna postrojba u gospodarstvu može se osnovati i kod gospodarskih subjekata koji to nisu obavezni prema kategoriji ugroženosti. Dobrovoljne vatrogasne postrojbe u gospodarstvu osnivaju se i djeluju na temelju Zakona o udrugama („Narodne novine“, broj 74/14, 70/17, 98/19). Prema odredbi članka 45. Zakona o vatrogastvu na postrojbu dobrovoljnog vatrogasnog društva u gospodarstvu smisleno se primjenjuju sve odredbe Zakona o vatrogastvu koje se odnose na dobrovoljna vatrogasnih društava u vezi s osnivanjem, ustrojem i prestankom djelovanja, ovlastima i odgovornostima predsjednika i zapovjednika te trajanju njihova mandata i primjenu ovlasti propisanih tim zakonom. Rad na konkretnom primjeru Profesionalne vatrogasne postrojbe u gospodarstvu „PVP Terminal Žitnjak“ obrađuje pitanja osnivanja, djelovanja, ustroja i financiranja profesionalne vatrogasne postrojbe u gospodarstvu. |
| Abstract (english) | Business entities are obliged to act in accordance with the Fire Protection Act ("Official Gazette", number 92/2010), the Rulebook on the Classification of Buildings, Building Parts and Areas into Fire Risk Categories ("Official Gazette", Number 62/1994) and the decision on classification into categories of danger from fire, and, depending on the category into which they are classified, take the measures prescribed by law and ordinance, create general acts, organize a fire service with a certain number of firefighters and a fire protection service, and finance them with their own funds. According to the Act on Firefighting ("Official Gazette", number 125/19), industrial fire brigades can be professional or voluntary. An industrial entity is obliged to organize an industrial fire brigade if it is classified in the I. or II. category of danger from fire, and then, based on the threat assessment and the fire protection plan, a professional fire brigade is organized. The number of mandatory professional firefighters decreases if the number of volunteer firefighters increases, and a voluntary industrial fire department can also be established in economic entities that are not required to do so according to the category of vulnerability. Voluntary industrial fire brigades are established and operate on the basis of the Associations Act ("Official Gazette", number 74/14, 70/17, 98/19). According to the provisions of Article 45 of the Act on Firefighting, all provisions of the Act on Firefighting that refer to voluntary firefighting companies in connection with the establishment, organization and termination of operations, the authorities and responsibilities of the president and commander, the duration of their mandate and the application of their authorities, are equally applied to the unit of a voluntary industrial fire brigade. This paper deals with the issues of establishment, operation, structure and financing of a professional industrial fire department based on the example of a professional industrial fire department "PVP Terminal Žitnjak". |
